Rules of Human Rights Law
In this course, Professor Conor Gearty (London School of Economics) discusses the rules of human rights law. In the first module, we explore the rules of human rights law, and the post-war context in which these rights emerged. In the second module, we discuss some of the major theories and philosophical traditions behind the values underpinning human rights. In the third module we contrast the concept of rights with the preceding tradition of liberties in English law, before turning to the EU and rights in the fourth module. In the fifth module we explore common law and its relationship with human rights in the UK. In the sixth and final module, we look at the changing nature of judicial powers and democracy in relation to human rights law.
Rules in Human Rights Law
In this module, we talk about the rules of human rights law in legal terms, and how they came about, focusing in particular on (i) the context of the Second World War for the emergence and consensus on human rights by European countries (ii) the formation of the European Convention of Human Rights by the Council of Europe (iii) rights protected by the ECHR (iv) the European Court of Human Rights in Strasbourg (v) developments in the UK to integrate human rights into British Law culminating in the creation of the Human Rights Act 1998.
